Poison centre notification for distributors from 1 January 2027: who needs to act now
From 1 January 2027 distributors must also notify hazardous mixtures to poison centres if they relabel them, sell them under their own brand or supply them to further EU countries where the data has not yet been notified. The basis is the amended CLP Regulation.
From 1 January 2027 the poison centre notification obligation also applies to distributors. Until now only importers and downstream users, for example re-fillers and formulators of mixtures, had to notify their hazardous mixtures to poison centres. The change is laid down in Article 45 of the CLP Regulation as amended by Regulation (EU) 2024/2865.
Which distributors are affected?
Distributors of mixtures classified for health or physical hazards are affected in two cases:
- Relabelling or own brand: you put your own label on the product or sell it under your name or brand (private label).
- Supply to further member states: you sell the mixture into an EU country where it has not yet been notified.
When does the obligation not apply?
The obligation does not apply if you can demonstrate that the appointed body in the country concerned has already received the same information, for example from the importer or the manufacturer. In practice this means: ask your supplier to confirm for which countries they have notified, and check whether the UFI on your label belongs to that notification.
What distributors should do now
- Check your range: which products are classified, which carry your label or brand?
- Ask your suppliers: in which countries has the product been notified, with which UFI?
- Close the gaps: for missing countries or your own labels, submit your own poison centre notification in the harmonised format via the ECHA portal.
- Adapt the label: the UFI on the label must match the notification.
